I chalked your second article up to the ignorant things non-lawyers write about court cases, i.e. that the answer was highly factually based and was being misconstrued. Hell, my own decisions have been terribly misconstrued by the press. I just read the decision. I think that I'm going to throw up now. It seems likely (thank god) that the state legislature or high court will fix this... but thats just disgusting!
